Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CDLCatch platform ("Platform") operated by CDLCatch ("CDLCatch," "we," "us," or "our") at cdlcatch.tech. By accessing or using the Platform — whether as a hiring company, a CDL driver applicant, or any other user — you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Description of Service

CDLCatch is a software-as-a-service (SaaS) platform that enables commercial trucking and transportation companies ("Companies") to recruit, screen, and manage CDL driver applicants ("Applicants"). Features include online driver applications, applicant tracking, electronic document management (eDocs), verification of employment (VOE), SMS and voice communications, and AI-powered recruiting tools.

CDLCatch acts as a technology platform and service provider. We are not an employer, staffing agency, or party to any employment relationship between a Company and an Applicant.

2. SMS Messaging Program

CDLCatch Driver Recruitment SMS Program

Program Description

CDLCatch sends SMS text messages to CDL driver applicants on behalf of hiring Companies. Messages may include: application status updates, requests to upload or complete documents, interview or onboarding scheduling, document signing reminders, and other communications directly related to your CDL driver application and recruitment process.

How to Opt In

You opt in to receive SMS messages by checking the SMS consent checkbox presented during the driver application process on our Platform. The checkbox is unchecked by default and requires your active selection. No messages will be sent without your explicit prior written consent.

Message Frequency

Message frequency varies based on the activity level of your application. You may receive up to several messages per week during active stages of your application review or onboarding.

Costs

Message and data rates may apply. Check with your mobile carrier for details on your plan.

How to Opt Out

You may opt out of SMS communications at any time by replying STOP to any SMS message from CDLCatch. After we receive your STOP request, we will send you a single confirmation message and you will receive no further SMS messages. You may also contact us at support@cdlcatch.tech to opt out.

No Sharing of Mobile Data

Mobile opt-in data and mobile phone numbers collected for SMS communications will not be shared with or sold to third parties or affiliates for marketing or promotional purposes.

Supported Carriers

Carriers are not liable for delayed or undelivered messages. Supported carriers include AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, US Cellular, and other major US carriers.

3. Account Registration (Companies)

Companies that wish to use CDLCatch must register for an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of applicable federal, state, or local laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and FMCSA/DOT regulations
  • Send SMS messages to individuals who have not provided prior express written consent
  • Submit false, misleading, or fraudulent information in any driver application
  • Attempt to gain unauthorized access to the Platform or other users' accounts
  • Use the Platform to harass, spam, or harm any person
  • Reverse-engineer, decompile, or otherwise attempt to extract the source code of the Platform

5. Driver Applicant Terms

If you are a CDL driver submitting an application through CDLCatch, you acknowledge and agree that:

  • All information you submit is true, accurate, and complete to the best of your knowledge
  • Providing false information may disqualify you from employment and result in your application being rejected
  • Your application data will be shared with the Company whose position you applied for
  • By checking the SMS consent checkbox, you are providing prior express written consent to receive autodialed and/or pre-recorded SMS messages from CDLCatch and the hiring Company to the mobile number you provided, in connection with your application. Consent is not a condition of employment.
  • You may revoke your SMS consent at any time by replying STOP

6. Intellectual Property

The Platform and all content, features, and functionality (including but not limited to software, text, graphics, logos, and icons) are the exclusive property of CDLCatch and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

7. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Platform is at your own risk.

8. Limitation of Liability

To the fullest extent permitted by law, CDLCatch shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, including loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages. In no event shall our total liability to you exceed the greater of (a) $100 or (b) the amounts paid by you to CDLCatch in the twelve (12) months preceding the claim.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the state in which CDLCatch is incorporated, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved through binding arbitration or, where arbitration is not available, in the courts of competent jurisdiction.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
